Terms of Service

These Terms of Service ("Terms") govern your use of the GetTRIX mobile application ("Application") operated by GetTRIX ("we," "us," or "our"). By downloading or using the Application, you agree to be bound by these Terms. If you do not agree, do not use the Application.

1. Eligibility

You must be at least 18 years old to create an account. The Application is intended for family use under the supervision and management of an adult parent or guardian. Children may use the Application only with parental consent and under parental management.

2. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at [email protected] of any unauthorized use of your account.

3. Acceptable Use

You agree not to:

Use the Application for any unlawful purpose or in violation of any applicable laws or regulations.
Attempt to gain unauthorized access to any portion of the Application or its related systems.
Reverse engineer, decompile, or disassemble any part of the Application.
Use the Application to transmit any harmful, offensive, or objectionable content.
Interfere with or disrupt the integrity or performance of the Application.

4. Subscriptions and Billing

GetTRIX offers a free tier and paid Pro subscriptions managed through Apple's App Store (In-App Purchases).

Free Tier: 1 child and 2 reward types, available indefinitely at no cost.
Pro Monthly: $4.99 per month. Renews automatically each month until cancelled.
Pro Yearly: $24.99 per year. Renews automatically each year until cancelled.

All billing is handled by Apple. Subscription management, cancellation, and refunds are subject to Apple's terms and policies. To cancel, manage your subscription through your Apple ID account settings. Cancellation takes effect at the end of the current billing period.

Prices are in USD and may vary by country based on local App Store pricing.

5. Referral Program

Pro subscribers may earn discounts by referring other families to GetTRIX. Each successful referral earns a 2% discount on your Pro subscription, up to a maximum of 10 referrals (20% maximum discount). We reserve the right to modify, suspend, or terminate the referral program at any time with reasonable notice. Abuse of the referral program may result in account suspension.

6. Intellectual Property

The Application and all of its original content, features, and functionality are owned by GetTRIX and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Application without our prior written consent.

7. User Content

You retain ownership of any content you submit through the Application (such as profile photos and family member names). By submitting content, you grant GetTRIX a non-exclusive, worldwide, royalty-free license to use, store, and display that content solely as necessary to provide the Application's functionality.

8. Privacy

Your use of the Application is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Disclaimers

The Application is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Application will be uninterrupted, error-free, or free of viruses or other harmful components. We are not responsible for the effectiveness of behavior management techniques used through the Application.

10. Limitation of Liability

To the maximum extent permitted by applicable law, GetTRIX shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Application. Our total liability for any claims arising under these Terms shall not exceed the amount you paid us in the 12 months prior to the claim.

11. Indemnification

You agree to indemnify and hold harmless GetTRIX and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including attorneys' fees) arising out of your use of the Application or violation of these Terms.

12. Termination

We may suspend or terminate your account at any time for violation of these Terms. You may terminate your account at any time through the Application settings. Upon termination, your right to use the Application immediately ceases, and your data will be deleted in accordance with our Privacy Policy.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the Application and sending an in-app or email notification. Continued use of the Application after changes take effect constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by and construed in accordance with applicable laws. Any disputes shall be resolved through good-faith negotiation first, and if unresolved, through binding arbitration.
